THIS IS A WEBSITE FOR PARENTS AND SOON-TO-BE PARENTS, OFFERING THEM A POSITIVE AND INTERESTING ENVIRONMENT WHERE THEY CAN CONNECT WITH OTHER PARENTS, SHARE INFORMATION, MAKE NEW FRIENDS AND DISCUSS ISSUES OF MUTUAL INTEREST. TO USE THIS SITE AND THE SERVICES OFFERED, YOU MUST BE 16 YEARS OLD OR OLDER. BY ACCESSING THIS SITE, YOU ARE CERTIFYING THAT YOU ARE AT LEAST 16 YEARS OF AGE. Registration:

You do not have to be a Member of Social Mommies to use this Website. However, only Members can access some of the most popular features and services that Social Mommies currently offers, such as use of forums, private messages, social networking features, or other services that we may offer in the future (the “Services”). Registration is free. We also offer paid services, please see this link for more information on subcription services.

When registering with Social Mommies there are several fields required. These fields include but are not limited to; Name, Age, Email Address, and other information. When registering you may choose not to receive email from administrators, it is recommended you receive administrator email but not required. You will also be asked to choose an alias and password. This is used to identify you and allow you to log in to the Website. You may not select or use a screen name of another person with intent to impersonate that person, use a screen name in which another person has rights without authorization from that person, or use a screen name that Social Mommies, at its sole discretion, deems offensive. You agree to provide true, accurate, current and complete information about yourself as prompted by the registration form, and maintain and properly update information to keep it true, accurate, current and complete. If you provide information that is untrue, inaccurate, not current or incomplete, or Social Mommies has reasonable grounds to suspect that you have, we have the right to suspend or terminate your membership and refuse any and all current or future use of the Website and the Services (or any portion thereof). Members should be cautious about sharing their account information with third parties. Each Member is responsible for the confidentiality of her/his screen name and password and all usage or activity on her/his account, including use of the account by any third party, whether or not such use is authorized by the Member.

Use of Services:

Most of the content on Social Mommies is submitted by our Members. We encourage you to take advantage of the many opportunities to interact with other Members by posting and reading content and participating in online discussions.

You acknowledge that by using the Website, you may be exposed to content that you find objectionable, indecent or offensive or which is inaccurate, misleading or incomplete. We are not responsible for the accuracy, completeness or usefulness of any content, nor do we endorse such content. We do not verify the identity of people using our Website. You use the Website and the content at your own risk.

As a convenience to you, we may provide links to websites operated by other entities, and you agree that Social Mommies have no responsibility for information which is referenced or linked by this Website. We are not responsible for any third party transactions via other websites users or advertisers or affiliates associated with Social Mommies. If you have had an unsatisfactory transaction please resolve this directly with the third party.

In the event that you have a dispute with one or more other users of this Website or other persons or entities advertising on the Website, you release Social Mommies from any claims, damages and demands of any kind and nature, known and unknown, arising out of or in any way connected with such disputes. You agree to indemnify and hold Social Mommies harmless against all claims and expenses, including reasonable attorney’s fees, arising out of or related to your use of the Social Mommies Website, violation of any law or regulation, violation of these terms and conditions, or violation of any proprietary or privacy right, or contracts formed with you through this Website.

When posting be aware that this is a public site. You are responsible for personal information you post about yourself. If for some reason a member should choose to delete their account from Social Mommies, we will not be responsible for removing any pictures, posts, or other personal information from the forums. If you are banned from Social Mommies you may Contact Us to have your instant messenger names, email, and location removed. The account will still exist as well as any content you submitted to the Website.

Although we do moderate our forums and other areas of the Website, we make no representations or warranties regarding the accuracy of any representations made and you agree that you will not hold us liable for any advice given or statements made via our Website. Due to the real time nature of the Website we can not catch everything. If you have concerns about a specific topic, please report it to a moderator or admin. You may report posts by using the "report" button or Contact Us.

Social Mommies reserves the right to suspend members’ accounts who repeatedly violate our Terms of Service and to immediately discontinue, suspend, terminate or block users’ access to this Website and/ or Services at any time.

We reserve the right, in our sole discretion, to correct any errors or omissions in any portion of the Social Mommies Website.

By submitting content to the Website, you grant to Social Mommies a perpetual, worldwide, royalty-free, and non-exclusive license to reproduce, distribute, modify, edit, display, adapt, create derivative works from and market and promote the content, for any commercial purposes, and in any medium now existing or hereinafter developed, and to use your name, likeness and any personal information you submit with the content without your prior approval or the payment of any compensation. You also grant each user of the Social Mommies Website a non-exclusive license to access your content as permitted through the functionality of the Website and under these TOS.

Forum signatures may include anything you like. Signatures must adhere to the TOS. If your signature is excessive in length or images it may be removed at the sole discretion of the staff of Social Mommies.

Members must not:

- Use any derogatory, racial or anti-religious comments, overly religious comments, or any content that is illegal. Use of any hate, bigotry, discrimination, or racism may result in an automatic account suspension.

- Post links to pornographic material. We do not allow pictures or links to pictures with nudity. (Exclusions include pictures of births or pictures for educational purposes, must have prior approval from an admin before posting).

- Attack other members through posts on the forums, email, private messages, comments, or any other communication used by Social Mommies. We do not allow harassment or personal insults. You may express opposing view points but we want our members to feel safe from abuse. Posts that are not respectful, rude or insulting to other members may be locked or moved. Please remember to conduct yourself in an adult manner.

- Use our Website for recruiting members to other forums or sites. This includes but is not limited to private messages or emails for the use of recruiting members, use of names or registration email from a site with the purpose of recruiting, posting topics or posts with "email me" or "pm me", or posting links to other sites for the purpose of recruiting. We are an open community but we will not tolerate recruiting for other sites what so ever. Members are allowed to use any other site, we do not dictate exclusivity.

- Troll on our forums. We do not allow multiple accounts to be registered at Social Mommies without administrators permission. We do not allow impersonating another member’s identity, stealing photos from others, or fictitious posting. We require a valid IP address upon registration, accounts to be found using a "false" ip will be suspended, for the safety and privacy of our members.

- Post “mod/admin bashing” topics. Any topics insulting or antagonizing the moderating team at Social Mommies may be locked or moved. If you disagree with a moderation decision, you may post in the Bash a Mod forum, send a private message, or email to an administrator expressing your concerns. If you choose to openly attack mods or admins in a hateful or discriminatory way, you will be warned and then an account suspension may result. Please conduct yourself as an adult.

- Post any spam, solicitations for money, charitable causes, or other products including but not limited to diapers, formula, coupons, etc. A warning will be issued, the post will be edited, and multiple spamming attempts will result in an account suspension. Please forward any emails or private messages that contain spam.

- Post research or journalism surveys on our forums.

- Post copyrighted material. If you have not personally written or created what is posted then do not post it. You can post links to articles or information. You as the user will be held responsible for any infringement. Posting an article that is not yours in whole or part must be credited. If you are unsure what this means please contact an admin or Contact Us.

- Post inappropriate or topics "baiting" the staff. Post appropriate topics on our forums. We have a Debates forum for controversial topics. Please post all debates on this forum. Controversial topics posted on other forums will be moved to the Debates board or locked. Topics "baiting" the staff will be moved to the Bash a Mod forum.

Use of Profanity:

Social Mommies does not allow profanity in public areas of the Website. This includes, but is not limited to, review submissions, article submissions, public forums, public blogs, public galleries, etc. Use of profanity in any form in public areas of the Website will be edited with out warning. Use of excessive profanity in public areas may lead to an account suspension. Please be aware of where you are posting profanity.

Liability:

You agree that any use of this Website, it's forums, or any content provided by Social Mommies is used at your own risk. You agree that Social Mommies have no responsibility for information which is referenced or linked by this site. You also agree that we, Social Mommies, its affiliates, or advertisers are not responsible for any and all third party links. You may report any inappropriate or unethical links to Social Mommies staff, but we are not required to respond to you.

United States law dictates that for something to be considered libel it must be proven that the person making the libelous charges did so with malicious intent and with the full and coherent knowledge that the statements were false. All personal opinions, statements and information posted on Social Mommies will be viewed as a First Amendment right. All opinions expressed on Social Mommies are the thoughts of a personal experience and are to be considered non-malicious and are the opinion of the member posting said information. Social Mommies and its owners will not be held responsible for the thoughts or opinions expressed by others on Social Mommies. All information posted on Social Mommies is to be considered as personal opinion and not fact by all members and non-members.

Content Removal Rights:

We reserve the right, but not the obligation, to monitor, edit or remove any content at any time and without notice, if we believe that the content violates these TOS or the Privacy Policy, removal is necessary to protect the rights, property or personal safety of Social Mommies, its users and the public, or if required to do so by law. We also reserve the right to remove postings that are off the subject or not in English. We can also remove content if we believe that doing so will improve our Website and the experience of our Members.

If you believe that any postings on the Website violate these TOS or the Privacy Policy, please let us know by using the “Report” button in the forums, sending a private message to a mod or admin, or using the Contact Us page. We try to review all reported violations and, if we agree with you, we’ll take appropriate action. However, in all cases, we are the final judge on whether these TOS or Privacy Policy have been violated and we will determine what, if any, action should be to taken.

We have the right to view and monitor any content posted to this Website, even if that content has been designated as “private,” if we have reason to believe that the content or the Member posting the content has violated these TOS or the Privacy Policy, or has engaged in conduct that is fraudulent, deceitful, unlawful or is or could be a threat to persons or property.

Do not reprint or reproduce any material for website or public use without permission from the owners of this Website.

Advertising:

You may advertise your company or website only if you have used the subcription service allowing you to do so or by express permission of the Social Mommies staff. If you do not have said permission your account may be suspended. We reserve the right to revoke any advertising permissions at any time for any reason. Subscriptions:

By purchasing a sponsorship plan you agree that you are making a payment to Social Mommies LLC. You agree that we will not refund or return your payment to us. You agree that you will not revoke and payments made to Social Mommies LLC unless fraud or identity theft has occured. You agree that in the event you are a victim of identity theft or fraud and you wish to revoke any funds from Social Mommies LLC, you will contact Social Mommies LLC before revoking any transactions. By agreeing to these terms we reserve the right to charge you any fees associated to you revoking your funds, this includes but is not limited to any fees charged to us by our financial institution, your financial institution, our credit card processing agent, or other fees associated. If you violate any of Social Mommies Terms of Service, we reserve the right to suspend your account and we will not refund your payment for any reason.
